Previous cases

Below is a selection of previous fitness to practice and dismissal cases held before the SSSC, the Employment Tribunal and the NMC. The people involved in these cases could very well have been people like you.


Although the primary objective in each case was to afford the people involved access to justice, there was more to it than this. Behind the legalities of each case is a human story. These are stories of gross unfairness where the people involved were treated in appalling ways that extended beyond the employer/employee relationship.


This is because people work to live, and how they are treated at work very often affects the way they live, especially where this calls their fitness to practice into question or results in their dismissal and subsequent loss of income.

  • Elizabeth McPhail

    Liz was accused of gross misconduct and stealing from her employer, despite the fact that she was innocent. She raised a grievance which was not upheld and was eventually dismissed. The Employment Tribunal upheld her unfair dismissal complaint.

  • Ricky, Terry and Jim, another colleague, were accused of theft and smoking on the premises. The employer did not carry out a proper investigation, and Ricky and Terry's claims were upheld by the Employment Tribunal.

  • Erica Makan

    Erica made protected disclosures about the treatment of residents in her care. Following this, she was subjected to a witch-hunt and persecuted for making the disclosures. The Employment Tribunal upheld that she had made a "qualifying disclosure."

  • Erica Makan

    Erica's fitness to practice was called into question by her employer in a tit-for-tat response to her protected disclosure claim succeeding at the Employment Tribunal. The NMC held that Erica's fitness to practice was not impaired.

  • Laura McConnachie

    Laura was dismissed by her employer after allegedly failing to deliver a "test letter." The employer's investigation into the matter was wholly inadequate, and the Employment Tribunal held that her dismissal was unfair.

  • Robert McColl

    Robert was accused of gross misconduct and dismissed. The employer's investigation into the allegations against Robert was flawed, and the Employment Tribunal held that he had been unfairly dismissed.

  • Elaine McSorley

    Elaine was falsely accused of abusing children in her care by two of her colleagues who for reasons best known to themselves, had taken a dislike to her. Her fitness to practice was called into question, but the SSSC held that she was fit to practice.
